Summary

Mr. Daniel Leung graduated from the University of Auckland in New Zealand, where he earned a double Bachelor’s degree in Commerce and Law. He subsequently obtained an LL.M. degree from China University of Political Science and Law and another LL.M. degree from Temple University in the United States. He later completed the Postgraduate Certificate in Laws (PCLL) at the University of Hong Kong. He is also an Affiliate of the Association of Chartered Certified Accountants (ACCA). Mr. Leung currently holds several distinguished professional and civic positions, including Member of the Hong Kong Professionals and Senior Executives Association, Vice President of the Shanghai - Hong Kong Professionals Association  (affiliated with the Shanghai Overseas Friendship Association), Member of the Greater China Legal Affairs Committee, Co-Chairman of the Organizing Committee of the Cross-Strait and Hong Kong Macao Young Lawyers Forum, and Member of the Regional Comprehensive Economic Partnership (RCEP) Committee of the Law Society of Hong Kong.

Experience

Mr. Leung has over twenty years of experience as a Hong Kong solicitor, having worked as a solicitor and partner at the Hong Kong offices of several leading international law firms. He is an experienced technology and global supply chain lawyer, with a broad practice covering product development and the full product lifecycle, including the global distribution of high-tech products across various industries—such as robotics, electric vehicles, smartphones, AI applications, ventilators, and advanced textiles. Mr. Liang also advises numerous domestic and international technology companies on ESG strategy, financing, data transfer compliance, intellectual property protection arbitration, and cross-border dispute resolution.

Mr. Leung frequently works closely with professionals across different global jurisdictions, including lawyers, tax advisors, accountants, company secretaries, bankers, surveyors, and architects, assisting clients in resolving issues related to global supply chain setup, distribution, and customs clearance.

He has become a trusted advisor to many professional clients, particularly company secretaries, accountants, and liquidators, assisting them with cross-border corporate restructuring projects and handling their local and cross-border compliance matters.

In addition, Mr. Leung qualified as a solicitor in England and Wales in 2008, obtained his solicitor qualification in the British Virgin Islands in 2022, and received the Guangdong–Hong Kong–Macao Greater Bay Area lawyer qualification in 2023.


REPRESENTATIVE MATTERS AND CASES:

AI Hardware Technology

• Advised on legal matters relating to the development and global distribution of AI hardware products.

• Providing legal due diligence services for global manufacturers or technology companies (such as OEMs or contract manufacturers) in connection with site selection for new locations, market entry research, and the construction of new factories (particularly in China).

• Advised technology supply chain clients on projects to establish new production lines in the Asia-Pacific region.


Supply Chain

• Advised on ESG strategy, technology financing, data compliance, intellectual property protection, technology dispute resolution, arbitration and litigation, and cross-border M&A transactions for technology companies, across industries such as robotics, electric vehicles, smartphones, AI applications, ventilators, and advanced textiles — from product development through to global distribution.


Local Compliance in Hong Kong SAR

• Advised on multi-jurisdictional corporate restructuring for liquidators, cross-border transfer of audit working papers for auditors, and compliance matters relating to the Audit and Financial Reporting Council (AFRC).

• Providing legal services on cross-jurisdictional corporate reorganizations, as well as local and cross-border compliance matters (including cross-border transfer of audit working papers and AFRC compliance issues).


Mergers and Acquisitions

• Advised clients on vertical and horizontal mergers and acquisitions with companies across different jurisdictions, including but not limited to due diligence, antitrust compliance, foreign direct investment (FDI) compliance, and various matters involving subsidiaries in overseas jurisdictions.


Cross-border Commercial Transactions

 Advised clients on a wide range of cross-border commercial transactions to facilitate their global investments and the establishment of overseas distribution networks.

• Advised liquidators on the sale of subsidiaries of companies in the process of liquidation.


Other General Commercial Works and Investment Fund Formation Matters

• Advised clients in the technology sector on fund formation matters, including the establishment of segregated portfolio companies (SPCs), offshore fund companies (OFCs), exempted limited partnerships (ELPs), and real estate funds.

• Advised manufacturing clients on cross-border employment matters, including cross-border hiring, large-scale layoffs, management changes, gift policies, team transfers, and personal injury and discrimination cases in the Hong Kong SAR, Chinese Mainland, Singapore, or other Asia-Pacific jurisdictions.

• Advised clients on various general commercial matters involving their offshore subsidiaries.


Technology Disputes Resolution and Sanctions

 Advised a China-based group company (primarily engaged in the manufacture of chemical raw materials and products) on its removal from the Specially Designated Nationals (SDN) list, successfully obtaining approval from the U.S. Department of the Treasury to delist the Chinese group company and revoke the applicable U.S. presidential executive order.

• Advised technology companies on complex technology disputes and litigation, providing legal services across relevant jurisdictions in the technology sector.

• Advised high-net-worth individuals or family offices in the technology sector on succession planning, family office establishment, and trust planning matters.

• Advised clients on restructuring the global distribution and customs duty calculation for their supply chains.
